Terms of Service

1. Who we are and what this agreement is 

These Terms of Service (“Terms”) are a binding agreement between Sales Superstarai (“Company,” “we,” “us,” or “our”) and you (“you” or “user”). They govern your access to and use of www.salessuperstarai.com and related services, including: 

Sales Superstar free audio courses (e.g., The Fundamentals, Module 1 & 2; Sales Management Superstar), which our site lists as Free after sign‑up.

The AI Personal Sales Trainer, a paid, subscription‑based training tool with advertised plan limits (e.g., minutes/credits per day) and a trial period, as described on the AI Sales Trainer page.

By using the Services, you accept these Terms. If you use the Services on behalf of a company or organization, you represent that you are authorized to bind that entity and “you” refers to it. 

2. Other agreements and policies 

Your use of the Services is also subject to our Privacy Policy (effective date as per  the Privacy Policy page), which explains how we collect and use personal information and provides contact details for privacy inquiries.  Contact information on our site includes contact@salessuperstar.ai and our Toronto address. Sales Superstar AI If a separate written agreement is executed for enterprise or custom services, that agreement controls to the extent of a direct conflict with these Terms. 


3. Eligibility; accounts; security

Minimum age.You must be at least 13 to use the Services and 18 to purchase a paid plan. If you’re under the age of majority in your jurisdiction, you may use free content only with a parent/guardian’s consent.
Account. You are responsible for your account credentials and all activity under your account. Keep your password secure and notify us promptly of any unauthorized use.
Accuracy. Provide accurate information and keep it up to date. 


4. The Services 

4.1 Free courses -Sales Superstar Our courses—including Sales Superstar – Module 1 (The Fundamentals), Module 2, and Sales Management Superstar—are presented as free on the site (after a one‑time sign‑up). Access terms may evolve; the current course catalog and access details are shown on the Courses pages. 

4.2  AI Personal Sales Trainer- a subscription based paid product is positioned as a personal AI sales trainer designed to help practice prospecting (door‑to‑door and telemarketing), presentations, closing, and objection handling, built on the Sales Superstar Fundamentals; the page also notes development by Jairek Robbins. Features, plan names, usage (e.g., minutes/credits per day), and any trial period are disclosed on the AI Personal Sales Trainer page and subscription screens.

4.3 Service changes We may modify or discontinue features, content, or functionality (including free courses or plan features) at any time, with or without notice. If we discontinue a paid plan in a material way during your paid term, we will either (a) provide a substantially similar replacement for the remainder of the term or (b) issue a prorated refund for the unused portion. 


5. Subscriptions, trials, billing, and taxes – AI Personal Sales Trainer 

Plans & pricing. Current plan names, prices, usage limits (minutes/credits), and inclusions (e.g., libraries, history, support) are shown at purchase and may change prospectively. Promotions or regional pricing may appear from time to time and are subject to posted terms.  

Trials. If a trial is offered, it converts to a paid subscription as advertised on the site, unless you cancel before the trial ends.  

Auto‑renewal. Subscriptions renew automatically for successive periods (monthly unless stated otherwise) until cancelled. 

Cancellation. You may cancel at any time; access continues until the end of the current billing period. 

Refunds. Except where required by law, fees are non‑refundable and we do not provide credits for partially used periods or unused minutes/credits. 

Taxes. Prices are exclusive of applicable taxes; you’re responsible for any taxes, duties, or similar governmental assessments. 

Payment issues. If payment fails or chargebacks occur, we may suspend or terminate access. 

Usage limits. Minutes/credits and any fair‑use caps reset and are tracked as disclosed in your plan; unused allocations do not roll over unless expressly stated on the website.


6. Acceptable Use & legal compliance 

You agree not to misuse the Services or assist others in doing so. Prohibited conduct includes (without limitation): Illegal, infringing, deceptive, harassing, or harmful activity; defamation; discrimination; or violation of others’ privacy or publicity rights. Violations of marketing/communications laws (e.g., CASL in Canada, TCPA/TSR in the U.S., Do‑Not‑Call rules), anti‑spam, and call‑recording/consent laws; and any local rules governing telemarketing, lead generation, or outreach. You’re solely responsible for compliance when you use outputs, scripts, or training derived from the Services in real‑world interactions. Uploading or generating content that contains personal data of children or sensitive personal information without lawful basis and necessary consents. Reverse engineering; scraping; automated extraction; benchmarking to build a competing service; bypassing security or usage limits; interfering with or overloading the Services. Unauthorized copying, distribution, resale, sublicensing, or public performance of our content (including Sales Superstar audio) outside the licenses below. We may suspend or terminate access (with or without notice) for suspected violations. 

7. Your content; AI outputs; feedback 

Your Content. You retain ownership of the prompts, inputs, and other content you submit, and the outputs you receive (subject to third‑party rights). You grant us a worldwide, non‑exclusive, royalty‑free license to host, process, transmit, display, and create derivative works from Your Content solely as necessary to provide, maintain, protect, and improve the Services, and to comply with law. See our Privacy Policy for how we handle personal information.

AI limitations. AI may generate incorrect, incomplete, or inappropriate content. You must review outputs carefully and use human judgment before relying on them. The Services provide educational coaching; no guarantee of sales performance, income, or specific results. 

Feedback. If you give feedback or suggestions, you grant us a perpetual, irrevocable, worldwide license to use it without compensation. 


8. Our content and intellectual property 

The Services, including the Sales Superstar courses, site content, logos, trade names, and related intellectual property, are owned by us or our licensors and are protected by law. Subject to these Terms: Free courses. We grant you a personal, limited, revocable, non‑transferable license to access and stream the free course content for your own learning. AI Personal Sales Trainer. We grant you a personal (or, for business plans, internal‑use), limited, revocable, non‑transferable license to access the AI Personal Sales Trainer during your paid term, consistent with your plan’s limits. 
You may not reproduce, distribute, modify, translate, sell, or create derivative works from our content except as expressly permitted. 


9. Third‑party services 

The Services may link to or rely on third‑party sites, tools, data, or payment processors. We are not responsible for third‑party content, policies, or services. Your use of third‑party services is governed by their terms. 


10. Confidentiality

If in using the Services you receive non‑public information that is identified as confidential or should reasonably be understood as confidential, you must use it only to access the Services and you must not disclose it to third parties without our consent. 


11. Service availability and data 

We strive for reliable operation but do not guarantee uninterrupted service. From time to time the Services may be unavailable due to maintenance, updates, or failures. We are not a backup service; keep independent copies of any important content, outputs, or settings. 


12. Term; termination 

These Terms continue until terminated. You may stop using the Services at any time, and you may cancel subscriptions per Section 5. We may suspend or terminate your access for any breach or suspected misuse, or if we discontinue the Services. Upon termination: (a) your license ends; (b) we may delete Your Content stored in the Services after a reasonable period, subject to law and our Privacy Policy. 


13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES (INCLUDING COURSES, AI PERSONAL SALES TRAINER, CONTENT, MATERIALS, AND OUTPUTS) ARE PROVIDED “AS  IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. 
We do not warrant that the Services will be error‑free, uninterrupted, accurate, or meet your performance goals. Training and coaching are educational; results vary. 


14. Limitation of liability 

TO THE FULLEST EXTENT PERMITTED BY LAW: 

Indirect damages. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST SALES; LOSS OF GOODWILL; OR LOSS/INACCURACY OF DATA, EVEN IF ADVISED OF THE POSSIBILITY. 

Caps. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO PAID SERVICES (E.G., AI PERSONAL SALES TRAINER) WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE PAID SERVICES IN THE 3 MONTHS BEFORE THE CLAIM AROSE. FOR FREE SERVICES (E.G., SALES SUPERSTAR COURSES), OUR TOTAL LIABILITY IS $0. 
Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the maximum extent allowed. 


15. Indemnification 

You will defend, indemnify, and hold us (and our affiliates, officers, directors, employees, and agents) harmless from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from: (a) Your Content; (b) your use of the Services in violation of these Terms or law; (c) alleged infringement or violation of third‑party rights by Your Content or use. 


16. Export, sanctions, and compliance 

You must comply with applicable export control, trade, and sanctions laws and not use the Services in restricted jurisdictions or for prohibited purposes. 


17. Changes to these Terms

We may update these Terms from time to time. We’ll post the updated Terms with a new “Updated on” date at the top. Changes are effective when posted. If you continue to use the Services after changes take effect, you accept the new Terms. 


18. Governing law; venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict‑of‑law principles. You and we submit to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario for any dispute not subject to other dispute‑resolution terms. 


19. Miscellaneous 

No waiver. A failure to enforce a provision is not a waiver. 

Severability. If any provision is unenforceable, the remainder remains in effect. 

Assignment. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. 

Entire agreement. These Terms (plus any plan‑specific terms, order forms, or enterprise agreements, and the Privacy Policy) are the entire agreement between you and us regarding the Services. 

Notices. We may provide notices by email, in‑product messages, or posting on the site.
